Huntsville Police Announce Implementation of the New Immigration Law
Huntsville, Alabama (October 28, 2011) In compliance with the Beason-Hammon Alabama Taxpayer and Citizen Protection Act, the Huntsville Police Department has modified its policy and procedures. HPD continues to train officers on the policy and procedures for enforcing the applicable sections of the Act.
The Act requires anyone driving a motor vehicle on a public roadway to have a valid driverís license in their possession. The Act authorizes law enforcement officers to arrest all drivers who are not in possession of a valid driverís license while driving a motor vehicle on a public roadway if their license status cannot be verified electronically.
HPD encourages all drivers to have their driverís license, registration, and proof of insurance in their possession while driving a vehicle. Huntsville City Ordinance allows the vehicle to be impounded if the driver is arrested.
The Act allows the arrest of any immigrant or alien who is unlawfully present in the United States and present in the State of Alabama.
Huntsville Police want to make it clear that this Act does not authorize local law enforcement to conduct worksite inspections for illegal immigrants or aliens. Only Federal Law Enforcement has that authority.
