Additional Information on the Termination
of Two Police Officers
Huntsville, Alabama (May 22, 2012) On Monday, May 21, 2012, the Huntsville Police Department announced the termination of two Police Officers. Based upon numerous inquiries from media outlets and the general public, coupled with the desire of the Police Department to disclose as much information as it can without adversely affecting the due process rights of the individuals involved (together with the fact that the identity of the officers has been disclosed by another, private, source), the Huntsville Police Department confirms the identity of the two officers as being Phillip J. Lee, Jr. and Brett Russell.
The Supreme Court of the State of Alabama, in Water Works and Sewer Board of the City of Talladega vs. Consolidated Publishing, Inc., 892 So. 2d 859 (Sup.Ct. Ala. 2004), held that government personnel disciplinary records are “sensitive personnel records” not subject to public disclosure until the completion of the name clearing hearing and any appeal process. Both of the officers involved have the right to appeal their termination to the City Council of the City of Huntsville. Until such time as the disciplinary appeal process has been completed, the Police Department will be unable to release additional information related to the termination of these two officers.
